1. Service Provider Identity

These Terms are provided by SustematiQ Sp. z o.o., with its registered office at ul. Św. Judy Tadeusza 8F, Unit 1, 55-095 Domaszczyn, Poland, entered in the National Court Register (KRS) under number 0001253359, NIP 8961670119, REGON 545235400, contact: info@sustematiq.com.

2. Services Covered

These Terms govern access and use of the SustematiQ website, marketing pages, contact form, guided project-intake form (Project Signal Builder), and the FoQus relaxation web application (including Guest mode, Local Profile mode, and Online Profile mode).

3. Electronic Services Disclosure (PSEM)

We provide our services by electronic means within the meaning of the Polish Act of 18 July 2002 on Providing Services by Electronic Means (Ustawa o świadczeniu usług drogą elektroniczną).

Technical Requirements: Utilizing the website and FoQus requires a terminal device with active internet access and a modern web browser (such as Chrome, Firefox, Safari, or Edge) configured to allow necessary cookies and browser localStorage.

Internet Risks: Use of electronic services involves typical security risks, such as unauthorized data access, malware, computer viruses, phishing, and service interruptions. Users are advised to take active steps to protect their terminal devices, including keeping their operating system, browser, and security software up to date.

4. FoQus Mode Rules

FoQus is provided in three modes representing different data boundaries:

• Guest Mode: Ephemeral session. No profile is created, data stays local and is lost on refresh or close, and no personal data is sent to SustematiQ.
• Local Profile Mode: Stored on browser/device storage only. Progress, preferences, statistics, badges, and reflections are saved locally and not sent to SustematiQ.
• Online Profile Mode: Submitted profile details only (name, email, and optional note) are sent to SustematiQ. Gameplay/session/progress/reflection history remains browser-local and is not uploaded.

Local progress data can be cleared by the user in browser settings or by utilizing the in-app reset button inside settings.

5. Eligibility and Minors

FoQus is not directed to children under 16. Users under 16 should not create an Online FoQus Profile. If you are under 16, you may only use Guest or Local Profile modes where no server-side personal data is processed by SustematiQ.

6. User Responsibilities

As a user, you agree to:

• Provide accurate contact and profile information.
• Do not misuse forms, guided intake workflows, or contact paths.
• Do not submit illegal, harmful, threatening, or infringing content.
• Do not attempt to interfere with website/app security or system integrity.
• Do not attempt unauthorized access to other profiles, logs, or databases.

7. Intellectual Property

All website content, design, text, logos, structures, software, soundscapes, audio files, and interactive gameplay concepts in the FoQus application are the exclusive intellectual property of SustematiQ or its licensors. You are granted a limited, personal, non-commercial, and revocable license to access the site and use the app.

SustematiQ and FoQus do not warrant or guarantee any specific business, research, health, emotional, project, or therapeutic outcomes from using the website, guided intake methods, or relaxation concepts.

10. Account and Profile Deletion

Users can request deletion of their Online FoQus Profile data at any time by contacting us at info@sustematiq.com. We will process your deletion request in accordance with GDPR timelines.
